DUI vs. DWI: What's the Difference?

Understand the difference between DUI and DWI charges, which states use which terms, and how it affects your case.

The terms DUI and DWI are often used interchangeably, but they can mean different things depending on your state.

DUI — Driving Under the Influence

Used in most states including California, Florida, and Arizona. Generally refers to operating a vehicle while impaired by alcohol or drugs.

DWI — Driving While Intoxicated/Impaired

Used in states like Texas, New York, and Missouri. In some states, DWI specifically refers to alcohol impairment while DUI covers drugs.

Other Terms by State

Ohio uses OVI (Operating a Vehicle Impaired), Indiana uses OWI (Operating While Intoxicated), Maine uses OUI (Operating Under the Influence), and Oregon uses DUII. Despite different names, the legal concepts are similar.

States That Use Both Terms

Some states like Maryland and New York distinguish between DUI and DWI based on BAC level. In Maryland, DWI (0.04-0.07%) is a lesser charge than DUI (0.08%+).
